This briefing provided an overview of the practical issues for practitioners when either a court indicates that it intends to make a reference to the Court of Justice for preliminary ruling pursuant to Article 267 TFEU or a practitioner is required to make submissions in favour or against a reference being made.
There was also a round-up of recent interesting reference from the Irish courts and an update on the amendments to the Statute of the CJEU, which now allow reference to be heard by the General Court where they concern certain specialised areas of law.
At the end of the presentation, participants:
* Had a better understanding of the issues that arise for practitioners when a reference is or may be made
* Were up to date in respect of significant reference from the Irish courts;
* Were up to date in respect of the new procedure allowing the General Court to hear certain references
